Platform Terms
These Platform Terms govern your use of the Shift platform — the SHIFT mobile app and our website at www.joinshift.com (the “Platform”) — operated by microagi GmbH, a limited liability company incorporated under the laws of Germany, with its registered office at Jülicher Straße 209 q/s, 52070 Aachen, Germany, and registered with the commercial register of the local court (Amtsgericht Aachen) under HRB 110642 (“Shift,” “we,” “us”). By creating an account or booking through the Platform, you (the “Client”) agree to these Platform Terms.

1. What Shift is
Shift is a marketplace platform that connects Clients with independent businesses that provide home and other services (each, a “Provider”), such as cleaning and, over time, additional service categories Shift may offer. Shift is not a service provider, cleaning company, employer, or staffing agency, and does not employ, direct, supervise, or control any Provider or its personnel.
Each service is provided by, and contracted directly between you and, the Provider identified to you at booking (the “Service”), under the separate Service Terms. Shift is not a party to that service contract and is not responsible for the performance, quality, safety, or outcome of any Service.
2. Eligibility and account
You must be at least 18 years old to use the Platform. You agree to provide accurate, complete information, to keep it current, and to keep your account credentials secure. You are responsible for activity under your account.
3. Booking through the Platform
The Platform lets you find and book a Service. When you book, Shift arranges the appointment with a Provider, and a service contract is formed between you and that Provider under the Service Terms, which are presented to you at booking and which identify the Provider as the contracting party. Shift facilitates scheduling and communication but does not perform the Service. At booking you separately accept the Provider’s Service Terms in addition to these Platform Terms.
4. Recording consent and pricing
For preferential-price bookings — free of charge or at a discount — the first-person (egocentric) video recording of the session is the agreed counter-performance for that price, and we use it to develop AI and robotics training data. The price, or that the booking is free, is shown to you before you book. Where a recording would involve special categories of data, we ask for your separate explicit consent, which you may withdraw at any time. The recordings are handled in accordance with the Privacy Policy.
- You authorize Shift, and the Provider’s personnel acting under the Shift recording program, to record the session at your location using Platform-approved equipment.
- You confirm that you are entitled to allow the recording at your location, and that you will inform any other persons present, in advance, that the session will be recorded. We apply measures to avoid or reduce the identifiability of others captured.
Your data-protection rights. You may exercise your privacy rights — including access, erasure and objection — as described in the Privacy Policy. Where you have given separate consent for special categories of data, you may withdraw it at any time. Your right to withdraw from the booking as a consumer is set out in Section 6a. You may also ask us to remove a recorded session until it has been de-identified and included in a dataset made available to others; after that point, removal from datasets already shared is limited, and we will delete it as far as technically possible.
Sensitive content. The recording is limited to the work being performed and its immediate surroundings. The Provider’s personnel are instructed not to record minors, intimate or medical situations, or sensitive identifiers, and recording may be paused or stopped at any time.
5. Your responsibilities
- Provide safe and lawful access to the location for the appointment.
- Before the appointment, secure or remove valuables, irreplaceable or fragile items, medications, hazardous materials, and sensitive documents.
- Ensure the location is safe for the Provider’s personnel and provide accurate information about it and the requested Service.
- Inform other adults present that the session will be recorded.
6. Pricing and payment
Pricing varies by Service and booking and is shown to you before you book. Some bookings are offered free of charge and others at a discount in connection with the recording program (see Section 4). If you cancel less than 24 hours before the appointment, a cancellation fee of EUR 100 applies; if you are not available to provide access at the appointment, a fee equal to the full price of the Service (or EUR 100 for free bookings) is due. The cancellation fee and any payment-card pre-authorisation are shown to you before you book, and we collect payment-card details only with your separate agreement.
Any amounts payable for a Service are owed to the Provider, which is the seller of the Service. Shift may collect such amounts on the Provider’s behalf as the Provider’s limited payment-collection agent and may use third-party payment processors to do so. Applicable taxes may apply and will be shown where required. Refunds and adjustments relating to the Service are handled by the Provider under the Service Terms.
6a. Right of withdrawal (distance contracts)
Right of withdrawal. As a consumer you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which the contract was concluded. This right also applies where the booking is free of charge and the recording is provided as counter-performance.
How to withdraw. To exercise the right of withdrawal, you must inform us — microagi GmbH, Jülicher Straße 209 q/s, 52070 Aachen, info@joinshift.ai — by a clear statement (for example a letter sent by post or an e-mail) of your decision to withdraw from this contract. You may use the model withdrawal form, but this is not mandatory. To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period expires.
Consequences of withdrawal. If you withdraw, we will reimburse all payments received from you without undue delay and no later than 14 days from the day on which we receive your notice of withdrawal. Where the recording is provided as counter-performance, we will stop processing the affected recording and delete it to the extent technically possible, as described in Section 4 and the Privacy Policy.
Early performance and value compensation. If you have expressly requested that the Service, including the recording session, begin during the withdrawal period, and you withdraw before the Service has been fully performed, you owe us a reasonable amount corresponding to the proportion of the Service already provided up to that point, calculated by reference to the agreed total price (Section 357a of the German Civil Code). Your right of withdrawal expires before the end of the period where the Service has been fully performed and its performance began only after your express request and your confirmation that you would lose your right of withdrawal upon complete performance (Section 356(4) of the German Civil Code).
A separate statutory withdrawal instruction and the model withdrawal form are provided to you before you book. Your data-protection rights remain unaffected by this Section.
7. The Platform is provided “as is”
Shift provides the Platform on an “as is” and “as available” basis and does not warrant that it will be uninterrupted or error-free. Because Shift does not provide the Service, Shift makes no warranty regarding any Service; warranties and responsibility for the Service are addressed in the Service Terms between you and the Provider. Your statutory rights as a consumer, including warranty and conformity rights, remain unaffected.
8. Privacy
Your personal information and the recordings are handled as described in the Shift Privacy Policy, which forms part of your agreement with Shift. Please review it to understand how data is collected, used, stored (including processing in the European Union), shared, and how you can exercise your rights. To carry out the appointment, we share the booking details and your contact details, including your phone number, with the Provider so that they can reach you. We may send you service messages relating to your booking (for example confirmations and reminders, including by SMS); we send marketing messages only with your separate consent, which you can withdraw at any time.
9. Limitation of liability
To the fullest extent permitted by law, Shift is not liable for any Service or for the acts or omissions of any Provider or its personnel; your remedies in respect of the Service are against the Provider under the Service Terms. To the fullest extent permitted by law, Shift is not liable for indirect, incidental, special, or consequential damages arising out of your use of the Platform. Nothing in these Platform Terms limits liability for death or personal injury caused by Shift’s negligence, for fraud, or for any liability that cannot be limited or excluded under applicable law. Shift remains fully liable for intent and gross negligence, for breach of essential contractual obligations (with liability for slight negligence limited to the foreseeable, contract-typical damage), and under mandatory product-liability law.
10. Indemnification
You are liable to Shift under the general rules of law for damage you culpably cause by breaching these Platform Terms, misusing the Platform, or failing to inform other persons present of the recording.
11. Changes
Shift may propose changes to these Platform Terms. We will notify you of material changes in text form at least six weeks before they are due to take effect. The changes are deemed accepted only if you do not object before they take effect; in the notice we will specifically draw your attention to this consequence, to the proposed effective date, and to your right to object and to terminate. If you object in good time, the changes do not take effect and either party may terminate the agreement with effect from the proposed effective date.
12. Governing law and disputes
These Platform Terms are governed by German law. If you are a consumer, you also keep the protection of the mandatory law of your country of residence. The ordinary courts have jurisdiction. Shift is not obliged or willing to participate in dispute-resolution proceedings before a consumer arbitration board.
13. Relationship to other terms
These Platform Terms govern your use of the Platform and your recording consent. The Service Terms (between you and the Provider) govern the Service itself. The Privacy Policy governs the handling of your personal information and the recordings. If there is a conflict about the Service, the Service Terms control; about the handling of data, the Privacy Policy controls; about the Platform and recording consent, these Platform Terms control.
